Lower limits than many countries
Spain already sets much lower legal alcohol limits than some other European countries, including the UK. For professional drivers, such as those in charge of school buses, the permitted level is lower still. For young drivers under 18, the legal limit is already zero. Legislation is also working through the system that could soon make Spain’s effective limit zero for all drivers.
Applies to all vehicles
These rules do not only apply to cars and motorbikes. They also cover bicycles, mopeds, and e-scooters — any vehicle used on the public road. A cyclist or scooter rider under the influence of alcohol or drugs is still breaking the law and putting themselves, and others, at serious risk.

The real risks
Even a small amount of alcohol or drugs affects reaction times, concentration, and judgement. Combined with unfamiliar roads, different traffic rules, and new surroundings — as many tourists face — the risk multiplies. The DGT (Dirección General de Tráfico) is clear: alcohol and drugs are a factor in one in three fatal collisions in Spain.
It must also be noted that alcohol takes time to leave your system, things like coffee are no help, and so you must be aware that the “morning after” may still pose a significant risk, such as when on the school run, for example.
Enforcement
The Guardia Civil and local police carry out frequent roadside checks, both in towns and on interurban roads. Drivers can be stopped at any time, tested for alcohol and drugs, and face heavy penalties if positive. Random checks are common, especially at weekends, holiday periods, and near areas with high nightlife activity.
A clear message
For residents and tourists alike, the safest approach is simple:
- If you are driving, do not drink or take drugs at all.
- Plan your night out with alternatives — taxis, public transport, or a designated sober driver.
- Remember: these rules apply equally to cars, scooters, bicycles, and buses.

Spain takes road safety seriously, and rightly so. Whether you are a professional driver, a parent on the school run, or a visitor hiring a car, the only safe limit is zero. Anything else risks lives.
