Reminder for Company Vehicle Drivers

We have reported this before, but as the deadline is fast approaching, it is worth reminding company vehicle owners of changes that affect them from 1 November 2022.

From 1 November 2022, the traffic department will no longer issue sanctions to company vehicle drivers through the post. Instead, they will notify the drivers electronically only.

For the legal eagles, this change is in accordance with the provisions of article 14 of Law 39/2015, of October 1 and, in this same line as of November 1, which states that company registered vehicles drivers must provide an Dirección Electrónica Vial (DEV), or Electronic Address, based on the provisions of article 60 of the Law on Traffic, Circulation of Motor Vehicles and Road Safety, Ley de Tráfico, Circulación de Vehículos a Motor y Seguridad Vial.

For this, all legal entities, or long-term users of a company vehicle, must have a DEV before that date, and they must provide an email and/or a mobile phone in order to receive the notices of the availability of the notifications that they may have pending. To register with the DEV, it is only necessary to have a valid digital certificate.

If this is not done, the General Directorate of Traffic will automatically assign a DEV to the company, which will receive traffic notifications electronically. When the ex officio assignment is made, the DGT will not be able to send the notices of the pending notifications to the email or mobile phone since it will not have these data, but the notification will still be available in the DEV mailbox, which must be accessed periodically to check for pending notifications.

Let us emphasise one important point. This ruling ONLY affects drivers of vehicles registered to a company. It does not affect the drivers of private cars. However, drivers of private cars can voluntarily register to receive notifications by electronic means. It will only be mandatory for drivers of vehicles registered to companies.

WHAT IS THE DEV?

The Dirección Electrónica Vial (DEV) is an electronic mailbox in which any person, natural or legal, can register to receive traffic notifications and notices and incidents related to administrative authorisations that the DGT must send electronically and with the same legal effects as the paper notification.

Registration is voluntary for individuals, as we mentioned before, but mandatory for Legal Persons who, as of November 1, will no longer receive paper notifications and will only be notified electronically through the DEV.
